By accessing or using BotHero.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of those changes.

2. Description of Service

BotHero.ai provides a platform for creating and managing AI-powered Telegram bots. The Service includes:

  • Bot configuration and management dashboard
  • AI-powered conversation processing
  • Lead capture and analytics
  • Knowledge base and RAG capabilities
  • Integrations with third-party services

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Not create multiple accounts to bypass limitations
  • Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

4. Subscription and Billing

4.1 Free Trial: We offer a 7-day free trial with limited features. No credit card required. Trial automatically expires without converting to a paid plan.

4.2 Paid Plans: Paid subscriptions are billed monthly or annually in advance. Pricing is available at bothero.ai/pricing.

4.3 Renewals: Subscriptions automatically renew unless cancelled before the renewal date. You will be charged at the current rate.

4.4 Cancellation: You may cancel anytime. Cancellations take effect at the end of the current billing period. No refunds for partial months.

4.5 Refunds: We offer a 14-day money-back guarantee on your first purchase. Contact support within 14 days for a full refund.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit spam, malware, or harmful content
  • Harass, abuse, or harm others
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Use bots for illegal activities, scams, or fraud
  • Scrape or crawl the Service without permission
  • Reverse engineer or attempt to extract source code

Violation may result in immediate account termination without refund.

6. Content and Intellectual Property

6.1 Your Content: You retain ownership of all content you upload or create using the Service. You grant us a license to use, store, and process your content to provide the Service.

6.2 Our Content: The Service, including design, code, logos, and documentation, is owned by BotHero.ai and protected by copyright and trademark laws.

6.3 Feedback: If you provide feedback or suggestions, we may use them without obligation or compensation to you.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with advance notice
  • Suspend service for security or technical issues
  • Modify or discontinue features with notice

Enterprise plans include SLA guarantees with uptime credits.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process message data to provide AI capabilities. Messages are encrypted and stored securely. You are responsible for complying with applicable data protection laws (GDPR, CCPA, etc.) when using the Service.

9. Termination

9.1 By You: You may close your account at any time through account settings or by contacting support.

9.2 By Us: We may suspend or terminate your account if you violate these Terms, fail to pay, or for other legitimate reasons with notice.

9.3 Effect: Upon termination, your access ends immediately. We will delete your data within 30 days unless legally required to retain it. You may request a data export before termination.

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE ARE NOT LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Actions or content of third parties (including AI model providers)
  • Service interruptions or data loss

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless BotHero.ai from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
